Pro Cool Air Conditioning & Electrical (“we”, “our”, “us”) is committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This Privacy Policy outlines how we collect, use, store and disclose your personal information when you interact with our website or services.

1. General

  • These Terms & Conditions apply to all quotes, bookings, sales, supplies, installations, service work, repairs and website use unless otherwise agreed in writing.
  • These Terms prevail over any inconsistent terms supplied by a customer unless we agree otherwise in writing.

2. Quotes and Pricing

  • Quotes are valid for 14 days unless otherwise stated in writing.
  • Prices are in Australian dollars and, unless stated otherwise, include GST where applicable for consumer-facing quotations.
  • We may vary a quote where the scope of work changes, site conditions differ from those originally disclosed or inspected, additional labour or parts are required, access conditions change, or supplier pricing materially changes before supply.
  • Any additional work outside the quoted scope will be charged at the agreed rate or, if no rate is agreed, at a reasonable market rate.

3. Orders, Bookings and Cancellations

  • Bookings are subject to availability and are not confirmed until accepted by us.
  • Orders for special-order, non-stock or customised items may not be cancelled once placed with our supplier.
  • Where we accept a cancellation, we may charge reasonable costs already incurred, including supplier cancellation fees, freight, administration and restocking charges.
  • A call-out fee may apply where access is unavailable, the site is unsafe, or an appointment is missed without reasonable notice.

4. Payment

  • Payment terms are as stated on the quote, invoice or statement. Unless otherwise agreed in writing, payment is due on completion for domestic work and within 30 days for approved trade or account customers.
  • Time for payment is of the essence. You must not withhold payment because of any set-off, counterclaim or dispute except to the extent required by law.
  • We may suspend further work, supply or credit where any amount remains overdue.

5. Interest and Recovery Costs

  • Overdue accounts may incur interest at 1.5% per month, calculated daily, from the due date until paid in full.
  • You agree to pay reasonable recovery, collection, mercantile agent, legal and administrative costs we incur in recovering overdue amounts, to the extent permitted by law.

6. Delivery, Risk and Title

  • Any stated delivery or completion time is an estimate only. We are not liable for delay caused by suppliers, transport providers, site readiness, weather, access restrictions or events beyond our reasonable control.
  • Risk in goods passes to you on delivery to site or collection, whichever occurs first.
  • Title in goods remains with us until all amounts owing for those goods and any other amounts due to us are paid in full. Until title passes, you must keep the goods identifiable and in good condition.
  • To the extent permitted by law, if payment is overdue we may enter the site or premises where the goods are located to recover them.

7. Claims, Returns and Shortages

  • You must inspect goods and notify us in writing of any visible damage, shortage or incorrect supply within 48 hours of delivery, and of any other defect within 14 days of becoming aware of it.
  • Returns are not accepted without prior approval. Approved returns must be unused, in saleable condition and accompanied by proof of purchase.
  • Special-order, electrical, refrigeration, consumable or installed items may not be returnable unless required by Australian Consumer Law.
  • Approved returns may be subject to freight and restocking charges.

8. Warranties and Australian Consumer Law

  • Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
  • Manufacturer warranties apply to parts and equipment supplied by us where relevant.
  • Our workmanship warranty applies for 12 months from completion unless another period is stated in writing.
  • Warranty claims do not cover fair wear and tear, misuse, neglect, improper maintenance, unauthorised repairs or modifications, abnormal operating conditions, damage caused by third parties, or failure to follow our instructions and manufacturer requirements.
  • To make a warranty claim, contact us promptly with proof of purchase, a description of the issue and reasonable access to inspect the goods or works.

9. Limitation of Liability

  • To the extent permitted by law, we are not liable for indirect, special or consequential loss including loss of profits, revenue, production, opportunity or goodwill.
  • Where liability cannot be excluded, our liability is limited, at our option, to resupplying the services, repairing or replacing the goods, or paying the cost of doing so.

10. Customer Responsibilities

  • You must provide safe, timely and unobstructed access to the work site, including access to electricity, plant and equipment as reasonably required.
  • You must disclose all relevant site conditions, hazards, prior faults, modifications and compliance issues known to you.
  • You are responsible for obtaining any owner, strata, landlord or site approvals needed for the work unless we expressly agree otherwise in writing.

11. Privacy

  • We collect, use, store and disclose personal information in accordance with our Privacy Policy and applicable Australian privacy laws.
  • By dealing with us, you consent to our handling of personal information for quoting, supply, service delivery, accounts, warranty support, compliance and related business purposes.

12. Website Use

  • Website content is provided for general information only and may change without notice.
  • You must not misuse the website, attempt unauthorised access, introduce malicious code, copy content without permission, or use the website for unlawful purposes.
  • Any downloadable materials, catalogues, images, logos, branding and written content remain our property or the property of our licensors.

13. Force Majeure

We are not liable for failure or delay in performing our obligations where that failure or delay arises from events beyond our reasonable control, including severe weather, flood, fire, strike, supply interruption, transport delay, power outage, government action or acts of God.

14. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
